ONSITE PARKING

The Sebel Melbourne Moonee Ponds has limited onsite, under cover car parking. Availability is limited and regrettably, we are not able to guarantee a space for our guests.

Additional charges for our car parking will apply, and our team would be more the happy to advise you of the cost at the time of confirmation of  your reservation or at the time of check-in.

Should you chose to utilise our car park, you will be agreeing to the below.

In these conditions references to: “we”, “us” and “our” mean Tuscan Rise Pty Ltd ATF Tuscan Rise Trust ABN 98 730 973 765 T/As The Sebel Melbourne Moonee Ponds or the local council and employees, agents and independent contractors or both; and “your vehicle” includes a vehicle driven, or intended to be driven by you into the car park.

Conditions of Entry and Limitation of Liability

1. You enter and use our car park at your own risk.
2. We are not liable for you or any person with you for:

• injury to you or anybody else;
• damage to, destruction of, theft of or unauthorized delivery up of your vehicle or any other vehicle whether authorized or not; or
• damage to, destruction of, theft of or delivery up of any property (Including anything in or on your vehicle or any other vehicle); however caused, and you release and indemnify us from any claim, which you might otherwise have against us.

3. You agree to indemnify us in respect of any claim made against us as a consequence of, in relation to, or in any way arising out of the use of this car park.
4. We will not be liable to you for delivery of your vehicle to any person who did not have authority to take your vehicle.
5. Infringement notices distributed for illegal parking in this car park are enforceable under contract law and local council by-laws
6. You agree to:

• Not to cause any obstruction;
• Not to park anywhere that we designate as a no parking area;
• Not to use this car park other than in accordance with instructions that an authorized officer may give;
• Comply with all reasonable directions and requests made by an authorized officer.

8. These conditions may only be altered by a written agreement between you and us.
9. If any of these conditions are illegal or unenforceable, the offending part is to be disregarded and does not affect the remaining part.
10. Each exclusion of our liability in these conditions is subject to any law, which restricts or forbids that exclusion of liability including the Trade Practices Act and similar Sate legislation.
